Terms of Service — Coastal Companion

1. Who we are

Coastal Companion (the “Service”) is operated by Coastal Companion LLC, a Michigan limited liability company (“we”, “us”, “our”). By creating an account or using the Service, you are entering into an agreement with Coastal Companion LLC. You can reach us at support@costal-companion.com.

2. Acceptance of these terms

By accessing or continuing to use the Service you agree to be bound by these Terms of Service. If you do not agree, you must stop using the Service. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization.

3. The Service

Coastal Companion provides marine weather, wind, surf, tide, and chart-plotter tools, plus a user-to-user marketplace, for recreational boaters. The Service is provided for informational and planning purposes only. You are solely responsible for your own safety on the water and for independently verifying conditions, navigation, and the seaworthiness of your vessel.

4. Acceptable use

You agree not to misuse the Service. You will not: (a) use the Service for any unlawful purpose; (b) engage in fraud, spam, harassment, or impersonation; (c) infringe the intellectual property or privacy rights of others; (d) attempt to interfere with the security of the Service, including by introducing malware, probing for vulnerabilities, scraping, or circumventing technical limits; (e) reverse engineer or resell the Service; or (f) use the marketplace for prohibited, counterfeit, or illegal goods.

5. Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

6. Intellectual property

The Service, including its software, design, branding, and content we provide, is owned by Coastal Companion LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes within your chosen plan. You retain ownership of content you submit, and grant us a limited license to host and process that content solely to provide the Service.

7. Payments and subscriptions

Paid subscriptions are billed monthly or annually as selected at checkout and renew automatically until cancelled. You can cancel at any time from your Profile or through Paddle's buyer portal at paddle.net; cancellation stops future renewals and you keep access through the end of the paid period. Payment, billing, tax, and refund mechanics are governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms and our Refund Policy.

8. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Marketplace

The in-app marketplace is a venue for users to list and discuss items. Coastal Companion is not a party to any transaction, does not process marketplace payments, and does not guarantee the accuracy of listings or the conduct of users. You use the marketplace at your own risk.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, or that weather, chart, or marine data will be accurate or complete. To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose). To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the claim, and we are not liable for any indirect, consequential, or special damages, including loss of profits, data, or damage to vessels or property. Nothing in these terms limits liability that cannot be limited by law (including for fraud or personal injury caused by negligence).

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time by cancelling your subscription and closing your account.

12. Changes to the Service or these terms

We may update the Service and these terms from time to time. If we make material changes we will update the “Last updated” date above and, where appropriate, notify you in-app or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-laws principles. Nothing in this clause limits any non-waivable consumer rights you may have under the laws of your country of residence.
